Robbed overseas, man wins insurance claim

Rebecca Samervel,

A district forum on Friday ordered an insurance firm to pay an MTNL principal general manager Rs 60,600 reimbursement and Rs 15,000 compensation after one of his bags was stolen on an official trip to Geneva in 2009.

The forum held that the robbery didn't hamper his return could not be grounds to repudiate the travel insurance claim. Mahendra Shedha had filed a complaint against ICICI Lombard General Insurance Company through the Consumer Welfare Association. He said he had taken the Global Trotter Overseas Individual Travel Insurance Policy valid from October 4-10, 2009. On October 10 at 5.30am, while Shedha was waiting with his luggage at a bus stop in Geneva, he found one his bags, containing 1,100 dollars, a camera and documents, missing.

He immediately lodged a police complaint and upon his return to India, filed a claim. But the firm rejected it on October 28, 2009. Shedha then filed a complaint in the Central Mumbai District Consumer Disputes Redressal Forum in 2011. The firm claimed Shedha could not provide details of stolen articles and said the loss was not substantial and led to no detrimental effect on his travel plans. The forum said that the loss it did affect his journey and was evidenced by the copy of his police complaint.
