Appeals court turns down rehearing for challengers to state car insurance law

By Charles Elmore

An appeals court has turned down a request for rehearing by challengers to Florida’s 2012 car insurance law, pleasing insurers who support benefit cuts they say will help fight fraud in the state’s Personal Injury Protection system.

The decision does not necessarily mark the last word in a protracted legal struggle, but for now it preserves moves supported by Gov. Rick Scott to restrict nonemergency benefits to $2,500 and bar massage and accupunture therapy since Jan. 1. Florida drivers are required to buy $10,000 of PIP coverage that pays for injuries regardless of who is at fault in an accident.
